    Any marriage where the man is not out working and the woman is staying home cooking, cleaning and raising the kids, is not a traditional marriage.

    Corrosive Frog - a small point for your consideration. It OCCURRED in the bible, in very old testament days. New testament, the new covanant brought in by Jesus, very clearly states one man, and one woman.

    Human - the people of California voted 60+ percent for the ban. I see that you are not a believer in democracy. But that aside, people can live freely in whatever arrangement they wish. I have a relative in Oregon who just had a very nice “treage” service. The three of them are very happy. I won’t tell you wich is the majority gender. What are you arguing for? A specific term for their arrangement? I’m sorry, but that comes across to me as shallow. No disrespect intended, but don’t you have work to do?

    It’s so unfortunate you posted this “fact” 3 times… so that I am correcting it 3 times. California voted 52 percent for the ban. That’s a lot less than 60%.

    Women’s suffrage also failed the first time (and in many places) by popular vote. Minority rights by popular vote do not tend to work.

    This is a *Republic *

    “And to the Republic for which it stands, one Nation under God, indivisible, with liberty and justice for all.”

    Of course I will not say that pledge again until I feel those last 2 words aren’t a lie. Learned that from a fourth grader. Anyway, a Republic helps to avoid the “tyranny of the majority” which would otherwise keep small groups from having equal rights.

    As an aside there was just released an evaluation of the voting patterns for Prop 8. If you wanted to ban gay marriage you needed to vote “no”. If you didn’t want a ban you needed to vote “yes”. Very complicated and possible designed by Jerry Brown to be confusing. After he wrote the ballot wording it was adjudicated but he won.

    It was determined that many people were confused and voted no when the meant yes and voted yes when they meant no.

    More people who wanted to ban gay marriage incorrectly voted (remember ballot in Florida) than visa versa. Probably if everyone’s preference were counted correctly the anti-gay marriage vote was 54% or 56% for. Black voters very strongly disapproved of gay marriage. And BTW, using that criteria Gore would have been President.

    “The people of California” voted over 60% that it wasn’t worth their time to go vote in the last election. Barry may have drawn 60% to the polls, but 60% of 60% is 36%, hardly an overwhelming endorsement. A coworker, who would like her daughter to be able to marry, didn’t register because she didn’t want jury duty. Many don’t register because they’re unaware that, in California, a felon can vote once they complete jail time & parole. I like to hope for a high turnout against both parties, giving my usual 4%/4th place finisher a chance. “Then monkeys will fly out of my butt.”

    Al Gore lost the votes of people who couldn’t get the landlord to fix the plumbing, or it wouldn’t have been close enough to bother the Supremes.

    Proposition 8 was overturned by the judge because it met neither the strict scrutiny test nor the rational basis test for allowing a government interest to override individuals’ Constitutional rights.

    Those who say that a majority of California voters should be able to override federal Constitution rights are ignorant of how our legal system works.

    If, say, the voters of Mississippi created a law re-instituting slavery, even by a vote of 100%, and it was overturned on the same grounds, would people like Loco80 again say the judge “not a believer in democracy”?

    Presumably so.

    dear 2816 i was reading the consitution and could not find marriage mentioned – the judge overturned it because the vote did not go the way he wanted it to go

    Exactly. Nothing in the Constitution bans gay marriage.

    Maybe on appeal your side should get someone with actual facts and a rational basis for such a ban instead of using a guy who has been proven time and time again by both sides to be a complete idiot with bogus “information.”
